Terms and Conditions

For the purposes of these regulations, the following definitions apply:

  • Client: anyone who intends to purchase the services offered by Top Sicily, which operates as an intermediary with carefully selected operators/suppliers from various sectors.
  • Operator/supplier: natural or legal person who, within the scope of their business activity, has entered into a collaboration agreement with Top Sicily to offer their professional services to clients who book through Top Sicily.
  • Intermediary: Top Sicily.

Activities

Top Sicily provides professional services in the tourism sector that are not attributable to traditional and/or pre-packaged tours. The client may purchase each service individually; for each request, the desired professionalism and/or service is made available. Client and supplier will agree on a customized program based on the client’s specific requests. The various services must be requested and purchased individually and not cumulatively.

Booking procedures and service delivery

The client, having selected the required service, will proceed with booking and payment (or: upon receiving confirmation of availability via email, will proceed with payment). Once payment is made, they will receive booking confirmation via email with detailed information (service, date, times, language, etc.) and the details (name and telephone contact) of the operator who has confirmed availability. In compliance with privacy and data protection regulations, the client’s details (name and telephone contact) will be provided to the aforementioned operator to enable contact for organizational details and program customization.

Any extension of services in terms of time, beyond the purchased package, must be agreed directly with the operator and paid to them.

Payments and invoices

Payments are made exclusively through the Top Sicily portal; the total cost includes any applicable taxes. Non-payment will not result in the booking request being processed. At the time of payment, the portal will automatically issue the relevant invoice to the purchaser.

Cancellation, cancellation procedures, refunds and liability

In case of booking cancellation by the client, regardless of the reasons, 100% of the amount will be refunded if cancellation occurs within 10 days before the scheduled service date, 50% between the 9th and 4th day before, while no refund will be due if cancellation occurs within 3 days preceding the scheduled date.

Exceptions apply to bookings for yacht/sailing boat excursions, helicopters, luxury cars and supercars, for which different cancellation terms are specified for each individual service at the time of booking.

No compensation is provided for cancellation when the intermediary demonstrates that the non-conformity is attributable to force majeure or fortuitous circumstances; no compensation is also provided when the intermediary demonstrates that the non-conformity is attributable to the client or a third party external to the service provision and having an unforeseeable or unavoidable character. In case of cancellation by Top Sicily, at any time, except for the cases described above, the entire booking amount will be refunded. Under no circumstances will Top Sicily refund amounts exceeding the booking amount made by the client.

To cancel any booking and receive any refunds, it is necessary to send an email to info@topsicily.com specifying the purchased service for which cancellation is requested; Top Sicily will proceed, within 7 days of receiving the request, to refund the amounts due according to the provisions of these terms and conditions, except for any taxes and fees already paid.

Safety and client protection

Top Sicily, operating as an intermediary, does not assume any safety and client protection obligations, which fall exclusively on the operator identified for the delivery of the service requested by the client.

Client obligations

  • Compliance with these regulations.
  • Proper use of services.
  • Payment according to the methods and terms established by these regulations.
  • Provide truthful and complete information.
  • Respect the schedules and organizational procedures agreed with individual operators provided by Top Sicily.

Top Sicily obligations

  • Provide clear and detailed information.
  • Promote the quality and conformity of services offered by operators.
  • Handle any complaints promptly and effectively.
  • Comply with personal data protection regulations.

Competent jurisdiction

For any dispute, the Court of Agrigento shall have jurisdiction.
